EB-5 visa for Indians is not a form to think about only after the H-1B result goes wrong. For many Indian IT professionals, the real cost of waiting is not only money. It is watching a child’s US plan move from choice to pressure.
Consider two illustrative family examples: Arjun and Kunal. Both are successful Indian IT professionals. Both have sons studying in America. Both want the same thing, a serious chance for their children to build a life in the US after graduation.
Arjun starts the EB-5 discussion while his son is still on an F-1 student visa. Kunal waits for the H-1B lottery. These are not presented as guaranteed outcomes or named client cases. They are practical examples of the decision many families face before timing, visa rules, and filing costs begin to narrow the choices.
EB-5 Visa for Indians: Two Families, One American Dream
For parents, the question is not only which visa category sounds better. It is whether the child can stay in the US after education without depending on one employer, one lottery, or one deadline. That is why EB-5 for F-1 students should be discussed before OPT pressure begins, not when the family is already out of time.
In this Acquest video, Paresh explains why a child’s future should not depend only on the H-1B lottery when EB-5 may be planned early.
Why H-1B Waiting Can Close Options
Many families know the student route: F-1, OPT, then perhaps H-1B. The risk is that H-1B is employer driven and capped. USCIS describes H-1B as a specialty occupation work visa, and cap-subject cases are limited each fiscal year. When demand is higher than available numbers, a qualified student can still be left out.
That is where EB-5 vs H-1B becomes a family planning question. H-1B may work well if the student is selected and sponsored. EB-5 is also not automatic, but it gives the family a separate route to examine, based on lawful funds, investment risk, project review, visa availability, and USCIS approval.
In Kunal’s situation, the problem is not that the family made one wrong decision. The problem is that the decision came too late. A lottery miss can force the family to discuss another degree, a transfer, relocation, or a return to India, after years of tuition and career planning.
What EB-5 Can and Cannot Do
USCIS describes EB-5 as a program where investors may seek lawful permanent residence for themselves, a spouse, and unmarried children under 21 if the required investment is made and the case supports job creation. In plain language, EB-5 may help a family plan beyond employer sponsorship, but it is still an immigration petition that must be proven.
The current EB-5 investment framework generally uses $1,050,000 as the standard amount, or $800,000 for a qualifying targeted employment area, called a TEA, or infrastructure project. A TEA is a qualifying rural or high-unemployment area. The investment must also support at least 10 full-time US jobs. Families should verify the current rule with immigration counsel before filing because eligibility depends on the project, documents, and timing.
An EB-5 Green Card case does not guarantee approval, speed, or a child’s future in America. It can only create a possible route if the family qualifies, documents the funds properly, selects a suitable project, and clears the immigration process.
The 2026 Cost of Waiting
Waiting may also have a confirmed government fee cost. A DHS final rule published in the Federal Register says the new EB-5 fees apply from November 30, 2026. The initial Form I-526E fee for a regional center investor rises from $3,675 to $7,850. The I-526E Integrity Fund fee rises from $1,000 to $1,100.
For a family considering EB-5 visa 2026, the extra government fee is not the largest cost in the journey. But if the family is already serious, it is one more reason not to leave Source of Funds review, project due diligence, and legal filing preparation until the last moment.
The October 2026 Visa Bulletin also shows why timing matters for Indian families. EB-2 India has a Final Action Date of November 1, 2013, and EB-3 India is January 1, 2014. EB-5 Unreserved India is December 1, 2023, while EB-5 rural, high-unemployment, and infrastructure set-aside categories are Current. Current means visa numbers are available for qualified applicants in that category for that month. It does not mean instant approval.
Why Parents Should Decide Before Options Shrink
The practical question is not whether every family should choose EB-5. The practical question is whether your family has studied H-1B lottery alternatives while there is still time to make a calm decision. For US Green Card for Indian students planning, late discovery is usually the most expensive discovery.
Arjun’s family still has to face EB-5 risk: investment risk, documentation, project choice, processing time, and visa availability. But the family has a parallel plan to evaluate. Kunal’s family waits for one outcome first, and when that outcome fails, every next step feels reactive.

Your child’s future should not depend on one lottery.
EB-5 timing, Source of Funds, and project choice all interact. Acquest can help your family understand whether EB-5 belongs in the plan before options narrow.
Plan While You Still Have Choices
If your child is studying in the US on an F-1 visa or approaching the H-1B lottery, don’t wait until uncertainty limits your options. Exploring EB-5 early gives your family time to assess eligibility, prepare Source of Funds documentation, and make informed decisions without last-minute pressure.
With EB-5 government filing fees set to increase from November 30, 2026, delaying your decision could also mean higher costs.
The difference between Arjun and Kunal wasn’t their financial position. It was their timing. One planned ahead, while the other waited for the lottery.
Your child’s American dream deserves a plan, not just hope. Explore your EB-5 options with Acquest Advisors before time and choices run out.

FAQ
Is EB-5 a guaranteed Green Card route for Indian students?
No. EB-5 must meet investment, Source of Funds, job creation, admissibility, and visa availability requirements. It can be a useful planning route, but families should treat it as a serious immigration and investment file, not a guaranteed result.
When should parents consider EB-5 for an F-1 student?
Parents should start the discussion before OPT or H-1B pressure becomes urgent. Early planning gives time to check age, funds, remittance steps, project suitability, and whether EB-5 fits the family’s wider US plan.
What changes on November 30, 2026?
Under the DHS final fee rule, the new EB-5 fee schedule applies from November 30, 2026. The initial I-526E fee rises to $7,850, and the I-526E Integrity Fund fee rises to $1,100.
